Phoenix Gone Wild Enforcing Ban on Swing Clubs
Action Plan To Fight for Swingers Privacy Rights

Thomas Jefferson, in the Declaration of Independence, wrote, "..that they are endowed with certain inalienable rights. ... That among these are life, liberty and the pursuit of happiness." I believe that sexuality falls under pursuit of happiness !

U.S. Supreme Court Justices say in Lawrence v. Texas:
"Liberty protects the person from unwarranted government intrusions into a dwelling or other private places. In our tradition the State is not omnipresent in the home. And there are other spheres of our lives and existence, outside the home, where the State should not be a dominant presence. Freedom extends beyond spatial bounds. Liberty presumes an autonomy of self that includes freedom of thought, belief, expression, and certain intimate conduct." [Kennedy, writing for the majority, 02-102, June 2003]
Or:
"A law branding one class of persons as criminal solely based on the State's moral disapproval of that class and the conduct associated with that class runs contrary to the values of the Constitution and the Equal Protection Clause, under any standard of review." [O'Connor, concurring in part, 02-102, June 2003

Phoenix is a "no fun" City - The kind of "no fun" atmosphere being engendered by the local government in Phoenix, is very bad for an economy with a large tourist dependency. Tourists want to have fun day and night. These kind of tactics which leave a national impression that Phoenix is a "no fun" regressive town is slowly leaving this area in the dust when competitors like Las Vegas, Miami, New Orleans are taking a different approach.  This may reduce the number of folks wanting to retire to Phoenix or have conventions, other than conservative religious right groups.

We suggest a 3-tier Action Plan to fight the City of Phoenix
1) Letter Writing Campaign to City Council and new Phoenix Mayor - see 1/1/04 link below.

2) If that fails to get any satisfaction the next but far more complex and expensive step is a voter iniative to get the law outlawing swing clubs in Phoenix rescinded.

3) Court Fight - Which is already underway by Club Chameleon and its attorneys, who has taken on the Court battle to protect YOUR rights as consenting adults
